Requesting an ALR Hearing

Office Work

In Texas, a DWI (Driving While Intoxicated) arrest often triggers an ALR (Administrative License Revocation) process, which can lead to the suspension of your driver's license. However, you have the right to challenge this suspension by requesting an ALR hearing. In this blog post, we'll guide you through the steps on how to request an ALR hearing and why it's a crucial aspect of your DWI defense.

Step 1: Act Quickly
Timing is critical when it comes to requesting an ALR hearing in Texas. You have only 15 days from the date of your DWI arrest to submit your request. If you fail to meet this deadline, your driver's license will be automatically suspended.

Step 2: Obtain a Copy of the DIC-25 Form
To request an ALR hearing, you must complete and submit the DIC-25 form, also known as the "Request for Administrative License Revocation (ALR) Hearing." You can obtain this form from your arresting officer, your attorney, or the Texas Department of Public Safety (DPS) website.

Step 3: Fill Out the DIC-25 Form
Carefully fill out the DIC-25 form, providing accurate and complete information. Be sure to include your contact information, details about your arrest, and any other required information.

Step 4: Mail or Deliver the DIC-25 Form
You have two options for submitting your DIC-25 form:
a. Mail: Mail the completed DIC-25 form to the address provided on the form. Be sure to send it via certified mail with a return receipt to ensure proof of delivery.
b. In Person: You can also hand-deliver the completed form to the nearest DPS office. Be sure to get a receipt as proof of submission.

Step 5: Pay the ALR Hearing Fee
As of my last knowledge update in September 2021, there was a fee associated with requesting an ALR hearing. Be prepared to pay this fee when you submit your DIC-25 form. Check the latest fee information on the Texas DPS website or consult with your attorney.

Step 6: Prepare for the ALR Hearing
Once your ALR hearing is scheduled, it's essential to prepare with the help of an experienced DWI attorney. Your attorney will gather evidence, subpoena witnesses, and build a strong defense strategy to challenge the suspension of your driver's license.

Step 7: Attend the ALR Hearing
On the day of your ALR hearing, be sure to arrive on time and dressed appropriately. Your attorney will represent you during the hearing, and you may be required to testify. The outcome of this hearing can significantly impact your ability to retain your driver's license.

Requesting an ALR hearing in Texas is a crucial step in protecting your driving privileges after a DWI arrest. Acting promptly, completing the necessary paperwork accurately, and seeking legal representation are key elements in this process. If you find yourself facing a DWI charge and the potential suspension of your driver's license, consult with an experienced DWI attorney to guide you through the ALR hearing process and provide the best chance of a favorable outcome.
